Pet Sitting Agreement
This is a sample of the agreement signed by both parties before every BuddySit sitting. The actual agreement is customized with each party's details and signed digitally.
1. Parties
This Pet Sitting Agreement ("Agreement") is entered into between the Pet Owner and the Pet Sitter (collectively "the Parties"), both registered members of BuddySit.com ("the Platform").
2. Services
The Pet Sitter agrees to provide the pet sitting service described in the associated booking, including care for the pets listed in the booking details, for the duration specified.
3. Pet Information Acknowledgment
The Pet Owner warrants that all information provided in the pet's profile is accurate and complete, including but not limited to: vaccination records, behavioral history (including any history of aggression or biting), medical conditions, dietary requirements, and emergency instructions. The Pet Owner acknowledges that intentional omission or misrepresentation of material facts voids this Agreement and constitutes a violation of Platform terms.
4. Liability
Each Party agrees to exercise reasonable care. The Pet Owner assumes full liability for any injury, damage, or loss caused by their pet, including to third parties, unless directly caused by the Pet Sitter's gross negligence or willful misconduct. BuddySit.com is a platform only and is not a party to this Agreement. The Platform assumes no liability for the actions of its members.
5. Emergency Authorization
The Pet Owner authorizes the Pet Sitter to seek emergency veterinary care for their pet if the Pet Sitter deems it necessary. The Pet Owner agrees to reimburse the Pet Sitter for any out-of-pocket veterinary expenses incurred in good faith. The Pet Sitter agrees to contact the designated emergency contacts before seeking care except in life-threatening situations.
6. Credits
Compensation for services rendered under this Agreement is conducted exclusively through the BuddySit credit system. Credits are held in escrow upon booking acceptance and released to the Pet Sitter upon booking completion, subject to the Platform's cancellation and dispute policies.
7. Behavioral Disclosure
The Pet Sitter acknowledges having reviewed the behavioral disclosures for all pets in this booking. Where aggression or biting history has been disclosed, the Pet Sitter accepts these risks knowingly and voluntarily.
8. Governing Law
This Agreement shall be governed by the laws of the state in which the sitting service takes place. Any disputes not resolved through the Platform's dispute resolution process shall be submitted to binding arbitration.
9. Electronic Signature
Both parties agree that electronic signatures, as captured through the BuddySit platform with IP address, timestamp, and device information, are legally binding and equivalent to handwritten signatures under applicable law.
